The first step is to determine the employment status of the person you are hiring. The key question is whether your worker is self-employed, employed through an agency, or directly employed by you. If your worker is not self-employed and is not paid through an agency, you are likely to be considered their employer — bringing legal responsibilities and rights into play.
These rules apply regardless of the type of work being carried out. Whether you’re hiring someone to provide care, maintain your garden, or offer personal assistance, the same considerations apply. Even if you receive direct payments from the NHS or local council to fund a carer, you may still be classified as their employer.
Employer Responsibilities
If you are deemed an employer, you must:

- Register as an employer with HMRC.
- Ensure compliance with auto-enrolment pension duties where applicable.
- Pay at least the minimum wage.
- Provide a payslip.
- Deduct and pay tax and National Insurance correctly.
It’s worth noting that changes to minimum wage rules took effect on 1 April 2024. Live-in workers, such as au pairs, are now entitled to receive at least the minimum wage, as the previous exemption has been removed.
